1. Acceptance of Terms

By creating an account, downloading our mobile application, or using any part of the BirdieConnect Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

BirdieConnect is a comprehensive golf platform that provides:

• GPS-based course information and distance tracking
• Score tracking and statistics with BirdieCap handicap calculation
• Social features to find playing partners and connect with golfers
• Club management and tournament organization through Birdie19
• Course discovery, reviews, and community tips
• Premium features including advanced analytics and exclusive content

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. User Conduct and Content

4.1 Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Harass, abuse, threaten, or harm other users
• Post false, misleading, or fraudulent information
• Spam, solicit, or send unsolicited communications

4.2 User Content

You retain ownership of content you post, share, or create on BirdieConnect ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and improving the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to post such content. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

5. GPS and Location Services

BirdieConnect uses GPS technology to provide course information and distance tracking. By using GPS features, you acknowledge that:

• GPS accuracy depends on device capabilities and environmental factors
• Distance measurements are estimates and should not replace professional course markers
• You should always follow course rules and safety guidelines
• We are not responsible for decisions made based on GPS data

6. BirdieCap Handicap System

BirdieConnect provides a USGA-compliant handicap calculation system called BirdieCap. You understand that:

• Handicap calculations are based on scores you submit
• You are responsible for the accuracy of scores entered
• Handicaps are calculated using official USGA formulas
• We are not responsible for how handicaps are used in competitions or tournaments

7. Birdie19 Clubs and Communities

BirdieConnect offers club management features through Birdie19. When participating in clubs, tournaments, or community features, you agree to:

• Follow club rules and guidelines established by club administrators
• Respect other club members and maintain a positive community environment
• Not use club features for harassment, discrimination, or illegal activities
• Understand that club administrators may moderate content and membership

8. Premium Subscriptions

8.1 Subscription Terms

Certain features of BirdieConnect are available through paid premium subscriptions. Subscription terms, pricing, and features are subject to change with notice.

8.2 Billing and Cancellation

Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

8.3 Refunds

Refund policies are governed by the payment processor and applicable laws. Contact support for refund inquiries.

9. Intellectual Property

The Service, including its original content, features, graphics, logos, and software, is owned by BirdieConnect and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

We strive to provide a reliable Service but do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available" without warranties of any kind.

10.2 Limitation of Liability

To the maximum extent permitted by law, BirdieConnect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason, including violation of these Terms. You may terminate your account at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BirdieConnect operates, without regard to its conflict of law provisions.
